ANJANA MISHRA ORAL ORDER 3 27-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 47-A of the Excise Act. Learned counsel for the petitioner submits that there has been no recovery from the conscious possession of the petitioner and he has no such criminal antecedent. It is further submitted that the name of the petitioner has been disclosed by one of the apprehended persons and that this petitioner has no role to play in the said occurrence.

Considering the aforementioned fact and also the fact that he has no criminal antecedent, let the petitioner, in the event of his

No.31483 of 2015 (3) dt.27-10-2015 P2/2 arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned SubDivisional Judicial Magistrate, Sikrahana at Motihari in connection with Rajepur P.S. Case No. 12/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
