The petitioner seeks bail in connection with Kajra P.S. Case no. 45 of 2016 registered under Sections 147, 148, 149, 353, 307 of Indian Penal Code and Sections 25(1-b)a/26/37/35 of Arms Act.

Petitioner along with other accused persons are said to have kept captive two Delhi based businessman at Hill located in village Mahua Koal and resorted firing upon the police party. Petitioner and one other accused, namely, Sintu Thakur @ Punam were apprehended by the police and some fire arm and ammunition have been recovered from the place of occurrence as well as from the accused Ranjeet Mandal. Anyhow, the victims were released from the hiding place.

It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.15809 of 2018(4) dt.23-05-2018 2/2 that no arm and ammunition has been recovered from possession of the petitioner. The allegation of resorting firing upon the police party is not specific rather general and omnibus in nature. So far as the allegation of kidnapping is concerned, another case namely, Hawai Adda P.S. Case no. 170 of 2016 has been lodged against the petitioner and others. No one has sustained any injury. Though, apart from the aforesaid Hawai Adda P.S. Case, one more criminal case has been lodged against the petitioner, but he is on bail in the said case. He has been languishing in custody since 9.05.2017 and the aforesaid Ranjeet Mandal and co-accused Sintu Thakur @ Punam have been enlarged on bail by this Court vide order dated 13.11.2017 and 04.04.2018 passed in Cr. Misc. no. 53999 of 2017 and 12832 of 2018 respectively.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureities of like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Lakhisarai in connection with Kajra P.S. Case no. 45 of 2016.
