2. In this case, the petitioner is seeking regular bail in connection with Rautara P.S. Case No. 48 of 2024, registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. As per allegation, on 13.06.2024, the informant along with police party was on patrolling duty, in the meantime, a pickup van was stopped for checking but the driver and the khalasi started fleeing away. The petitioner was apprehended and thereafter when the pickup van was searched, total 609 L foreign liquor and three quintal mango was recovered.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.59377 of 2024(2) dt.28-08-2024 2/2 petitioner is innocent and has falsely been implicated. Nothing has been recovered from the conscious possession of the petitioner. He is a person of clean antecedent and is under custody since 15.06.2024.

5. On the other hand, learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named, is directed to furnish bail bond after three months from today and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge Exclusive Excise Court NO. 2, Katihar in connection with Rautara P.S. Case No. 48 of 2024, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
