2. The petitioner seeks regular bail in connection with Kiul Thana P.S. Case No. 51 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, on secret information police reached at the marked place and saw a man sitting on the bridge with yellow sack. Seeing the police, he started fleeing away leaving the sack but on chase he was apprehended and disclosed his name as petitioner. It is alleged that from the sack 60 litre country made liquor was recovered.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Nothing has been recovered from the
Patna High Court CR. MISC. No.58013 of 2025(2) dt.04-09-2025 2/2 conscious possession of the petitioner. Recovery has been made from an open place. Petitioner was only sitting there. Petitioner has no concern with the seized liquor. There is no compliance of Section 103 of the B.N.S.S. Petitioner has one criminal antecedent of similar nature. He is in judicial custody since 19.06.2025. Petitioner undertakes to co-operate in the trial.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties and facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge 7th cum Special Excise Court 2nd, Lakhisarai in connection with Kiul Thana P.S. Case No. 51 of 2025.
