The petitioner seeks bail in Durgawati P.S. Case No. 192 of 2017 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner along with four other accused persons are said to have gunned down the husband of the informant. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case. Informant does not happen to be eye witness of the occurrence. Tahlu Pandey and Banti Singh were subsequently apprehended and they have
Patna High Court Cr.Misc. No.25563 of 2018 (3) dt.23-05-2018 2/2 confessed that Tahlu Pandey and Radheyshyam Pandey shot the deceased. In the post mortem report, doctor has found two fire arm injuries on the person of the deceased. The petitioner has been languishing in custody since 09.10.2017. Said Tahlu Pandey, Radheshyam Pandey and Chandan Sah have been enlarged on bail by different co-ordinate benches of this court. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur in connection with Durgawati P.S. Case No. 192 of 2017, G.R. No. 2109 of 2017.
