Petitioners are apprehending their arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 147, 323, 354, 380, 452 of the Indian Penal Code.

It is alleged that petitioners entered into the house of the complainant, demanded rupees fifty thousand as extortion and made an attempt to establish forceful physical relationship with the complainant. It is also alleged that lady accused with the help of Sitaram Singh snatched gold ear ring and gold chain of the complainant when Nita Singh snatched her silver payal.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.46635 of 2014 (2) dt.21-04-2015 2/2 petitioners that petitioners are agnates of the complainant. The petitioners filed Complaint Case No. 289C of 2014 against the complainant's side with accusation under Sections 307, 386, 387, 394, 452, 34 of the Indian Penal Code and Section 27 of the Arms Act on 21.02.2014 which came to be registered as police case on 18.07.2014, whereas the present complaint was filed on 19.02.2014.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the fact that complaint was filed on 19.02.2014 for the occurrence of 17.02.2014 and the petitioners being agnates of the complainant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Jamui in connection with Complaint Case No. 269C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
