The petitioner has been in custody since 11.10.2017 in connection with Sahebganj P.S. Case No. 289/2017 registered for the offences punishable under Section 120(B) of the Indian Penal Code and Sections 25(1-b) a/25(1-A)/25(1-AA)/25(1AAA)/26(2)/27(2) and 35 of the Arms Act, Section 3 and 4 of Explosive Substance Act and Sections 16/17/18/20/22 and 23 of the U.A.P. Act.
Learned counsel for the petitioner submits that only on the suspicion, the petitioner has been taken into custody as a part of the Naxal group and having connections with the said organization. It is further submitted that the petitioner was taken into custody on being in illegal possession of pipe-gun and one
Patna High Court Cr.Misc. No.18574 of 2018 (3) dt.26-04-2018 2/2 cartridge and the petitioner has already been in custody for over six months. He further submits that other case in which he has been implicated is for an occurrence which took place on the eve of Holi and due to local village politics.
In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur, in connection with Sahebganj P.S. Case No. 289/2017.
