The petitioner seeks bail in N.D.P.S. Case No. 46 of 2020, arising out of Delha P.S. Case No. 202 of 2020, registered for the offence under Sections 21(b), 27, 29 of the NDPS Act. It is submitted on behalf of petitioner that no narcotic substance has been recovered from the possession of this petitioner and from bare perusal of F.I.R., it is apparent that recovery has been made from other co-accused persons, who were apprehended on spot and only on the disclosure made by co-accused, petitioner has been made accused in this case. Petitioner is in custody since 13.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the fact that no narcotic substance has

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 1st, Gaya in connection with N.D.P.S. Case No. 46 of 2020, arising out of Delha P.S. Case No. 202 of 2020.
