The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201 and 120B of the Indian Penal Code.

The prosecution case is that the informant's son Md. Kurban died at his in-laws place when the informant visited the wife of the victim Rashida Khatoon was not available in the house. It is alleged that the wife of the victim has illicit relationship with Md. Jasim @ Doman, who happens to be her maternal brother. The petitioner is not named in the FIR. His name subsequently sprang up, who happens to be father-in-law of the victim against whom it is alleged that this petitioner was

Patna High Court Cr.Misc. No.6111 of 2016 (2) dt.08-02-2016 2/2 given rupees forty thousand by the victim at the behest of his daughter Rashida Khatoon.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and the FIR named accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 36880 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Halsi P.S. Case No. 26 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
