The petitioner seeks regular bail in connection with Dariyapur P.S. Case No. 320 of 2016, registered for the offence punishable under Sections 302, 201 and 120(B) of the Indian Penal Code.

The allegation is regarding unknown accused persons having killed Deepak Kumar.

The learned counsel for the petitioner submits that the name of the petitioner has transpired on account of confessional statement made by Dinesh Kumar and Sunaina Devi. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 28.02.2017. Per contra, the learned APP for the State has submitted

Patna High Court Cr.Misc. No.26980 of 2018(3) dt.09-07-2018 2/2 that apart from the confessional statement of Dinesh Kumar and Sunaina Devi, there is no other material to connect the petitioner with the alleged crime.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J., IInd Saran at Chapra in connection with Dariapur P.S.
