1. Heard the learned Advocate for the petitioners and the learned APP for the State.
2. The petitioners seek bail in a case instituted for the offences under Sections 191(2), 190, 126(2), 115(2), 118(1), 117(2), 303(2), 74, 109(1), 352 and 351(2) of the B.N.S.
3. The learned counsel for the petitioners has submitted that the petitioner no.1 has antecedent of one case and petitioner no.2 has antecedent of two cases and petitioner no.1 is a woman and they are in custody since 28.05.2025. It is next submitted that Om Kumari Devi had approached this Court seeking anticipatory bail by filing Cr. Misc. No.49983 of 2025 and the same came to be allowed by an order dated 11.08.2025 and one Tez Narayan Pandey had approached this Court seeking
Patna High Court CR. MISC. No.54431 of 2025(3) dt.19-09-2025 2/2 anticipatory bail by filing Cr. Misc. No.52362 of 2025 and the same came to be allowed by an order dated 19.09.2025. It is submitted that case of petitioner no.1 is similar to the case of Om Kumari Devi while case of petitioner no.2 is similar to the case of Tez Narayan Pandey, but then, Om Kumari Devi and Tez Narayan Pandey were given the privilege of anticipatory bail whereas petitioners are seeking regular bail, as such, their case is on a better footing.
4. The learned A.P.P. opposes the bail application.
5. Considering the submissions and taking into consideration the order dated 11.08.2025 in Cr. Misc. No.49983 of 2025 and the order dated 19.09.2025 in Cr. Misc. No.52362 of 2025, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Nivash Sharma, learned JMFC- cum- AM, Motihari, East Champaran in connection with Dumaria Ghat P. S. Case No.65 of 2025.
6. The application stands allowed.
