JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-05-2018 The petitioner seeks bail in connection with Singhwara P.S. Case No. 183 of 2017, dated 11.10.2017, instituted for the offences punishable under Sections 328 and 302 of the Indian Penal Code.
The petitioner is alleged to have assaulted her father-in-law (deceased) and also administered some deleterious substance to him, leading to his death. The First Information Report has been lodged by the mother-in-law of the petitioner, who has alleged that the petitioner is a cantankerous lady, who fought with everybody. On an earlier occasion, it has been alleged that she had caused injuries to her husband as well. On one occasion, she
Patna High Court Cr.Misc. No.25480 of 2018 (3) dt.17-05-2018 2/2 threatened the family members of the informant of killing her own children by electrocuting them. On 09.02.2017, it has been alleged by the informant/mother-in-law of the petitioner that the petitioner had assaulted the deceased and had also administered poisonous substance to him, leading to his death.
Learned counsel for the petitioner has submitted that a vague allegation with respect to administration of poisonous substance to the deceased has been made in the First Information Report. What substance was the deceased made to drink or consume is not known. The viscera report is still awaited.
The petitioner is in custody since 23.10.2017. Regard being had to the fact that the petitioner is the mother of two small children and is in custody since 23.10.2017 and the present case arises out of some domestic dispute, the petitioner, abovenamed, is directed to be released on bail on her furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Darbhanga in connection with Singhwara P.S. Case No. 183 of 2017.
