The petitioner seeks bail in connection with Motihari Town P.S. Case No. 518/2017, registered for the offence punishable under Sections 302, 506, 509 and 120B of the Indian Penal Code.

Accused Aditya Kumar @ Nanhe and Ambika Dutta @ Chhotu are said to have committed murder of son of the informant by taking him from his house and when the informant along with his brother approached the petitioner, he asked them to leave his house else to face the dire consequence.

It is submitted by the learned counsel for the petitioner that petitioner is not the assailant. The only allegation against the

No.53789 of 2017 (2) dt.09-11-2017 2/2 petitioner is that when the informant and his brother approached the petitioner regarding the occurrence committed by his son, he asked them to leave his house else to face the dire consequence. The petitioner has been languishing in custody since 27.07.2017. Considering the facts and circumstances of the case, the above named petitioner, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran in connection with Motihari Town P.S. Case No. 518/2017.
