The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
Petitioners are parents of the husband of opposite party No.2. General and omnibus allegation is under Section 498A I.P.C. and 4 of the Dowry Prohibition Act. Submission is that petitioners are always ready for
Patna High Court CR. MISC. No.53906 of 2019(4) dt.10-12-2019 2/2 restoration of cordial relationship. The husband of opposite party No.2 is also ready for the same.
Considering the entire facts and circumstances as well as future chances of settlement, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Complaint Case No. 1436C of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
The order has been passed in presence of learned counsel for opposite party No.2. Opposite party No.2 shall file a petition before the learned court below regarding restoration of relationship, if she so desires.
