The petitioner seeks bail in connection with Hajipur Town P.S. Case No. 621 of 2016 for the offences punishable under Sections 365, 366(A), 328/34 of the Indian Penal Code.
The allegation is regarding the petitioner having abducted the victim girl and sold her in a brothel. The learned counsel for the petitioner submits that the statement of the victim girl under Section 164 Cr.P.C would itself show that the victim girl was living with another person namely Ramu Giri at Bareily and when she had come back to her parents
Patna High Court Cr.Misc. No.22698 of 2018 (4) dt.02-07-2018 2/2 she had stated that she did not have any grudge against Ramu Giri. The learned counsel further submitted that the petitioner has a clean antecedent and is languishing in custody since 22.08.2017. Lastly, it is submitted that no evidence has come during investigation conducted by the Police regarding the petitioner having sold the victim girl at Bareily.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S.
