The petitioner apprehends his arrest in a case under Section 420, 379/34 of the Indian Penal Code and Section 40 of the Bihar Mineral Act.

The petitioner was filling earth in his land by cutting it from inside the river bed through J. C. B. illegally. It is submitted that driver of J. C. B. and others have already been enlarged on anticipatory bail by learned Sessions Judge vide order passed in A. B. P. No. 65/2015. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on
