The petitioner seeks regular bail in connection with Wazirganj P.S. Case No. 79 of 2018 for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.
The allegation is regarding the accused person, namely, Binod Yadav, having arrived at the house of the informant and thereafter had taken him to the Vishwakarma temple from where the informant was dragged and taken to Daru Bhathi, where the said accused person and other accused persons including the petitioner herein had assaulted him, resulting in fracture in his leg and hand.
The learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.52758 of 2019(3) dt.16-11-2019 2/2 petitioner is innocent and no specific allegation of any overt act has been alleged qua the petitioner herein. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 29.06.2019. Lastly, it is submitted that the other accused persons, similarly situated, have been granted bail by this Court vide orders dated 03.08.2018, 18.08.2018 and 24.09.2018 passed in Cr. Misc. Nos.43003 of 2018, 35617 of 2018 and 24.09.2019, respetively. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Gaya in connection with Wazirganj P.S. Case No. 79 of 2018.
