Petitioner is in custody in connection with Case No. 68 C2/03 for the offence under section 47(a)(f) of Excise Act. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.
Learned counsel submits that earlier bail was granted to the petitioner but due to lack of pairvi bail bond of the petitioner was cancelled and he was arrested on 28.6.2019. In the aforesaid case no witness was turned up before the trial court and due to death of leaned counsel trial was not conducted properly.
Considering the totality of facts situation discussed
Patna High Court CR. MISC. No.53905 of 2019(2) dt.30-08-2019 2/2 hereinabove, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum- Special Judge (Excise), Lakhisarai, in connection with Case No. 68C2 of 2003 subject to the condition that in the event the petitioner fails to attend court proceeding on two consecutive dates without any cogent reason, the Court below shall be at liberty to cancel the bail bond of the petitioner.
