JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 04-02-2015 Cr. Misc. No.46636 of 2014 wherein Chandradeo Singh and Kailash Singh are the petitioners and Cr. Misc. No.46677 of 2014 wherein Mukesh Singh happens to be the petitioner commonly originate out of Gopalpur P. S. Case no.247 of 2014 (wrongly mentioned in the order impugned as Gopalpur P. S. Case no.247 of 1994) and on account thereof, heard analogously and are being disposed of by a common order. Heard, learned counsel for the petitioners as well as
learned Additional Public Prosecutor.
At an earlier occasion, wife of informant namely Anju Devi eloped with Mukesh Singh, for which Panchayati was convened, wherein it was resolved that as both the parties are married one, therefore, they should live along with their family without having connection to each other while Anju Devi, deceased was living with the informant and during course thereof, while she had gone to scrap grass on 21.07.2014 did not return. In course of search, her dead body was found hanging with a tree. So far, status of petitioner Chandradeo Singh and Kailash Singh are concerned, apart from having been suspected in the fard-bayan, no concrete evidence has been collected during investigation against them as is evident from order impugned.
Consequent thereupon, petitioners Chandradeo Singh and Kailash Singh are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Naugachhia, Bhagalpur in connection with Sessions Trial No.770 of 2014 arising out of Gopalpur P. S. Case no.247 of 2014.
So far, petitioner Mukesh Singh is concerned, apart from his conduct, the Chunauti found near the dead body was
identified to be that of petitioner along with his confessional statement leading to recovery of the rope.
As such, I do not see it a fit case for grant of bail. Accordingly, prayer of petitioner for bail is rejected. (Aditya Kumar Trivedi, J) Vikash/- U T
