JUSTICE ARUN KUMAR ORAL ORDER 24-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Phulwarisharif P.S.Case No. 529 of 2017 registered under Sections 302/34 of the Indian penal Code and Sections 25(1b)a/26/27 and 35 of the Arms Act. Allegation in brief is that one Shravan Kumar called the brother of the informant and it is alleged that all accused persons started assaulting him, in the meanwhile, Kundan Kumar and Sharvan Kumar fired at his brother causing his death. Submission is that allegation of killing the deceased is specific on Kundan Kumar and Sharvan Kumar and not against this petitioner and similarly situated two co-accused persons have been admitted to bail by a co-ordinate Bench of this Court vide order dated 12.01.2018 passed in Cr. Misc. No. 1102 of 2018 and

Patna High Court Cr.Misc. No.62326 of 2017 (3) dt.24-01-2018 2/2 vide order dted 15.01.2018 passed in Cr. Misc. No. 2657 of 2018 and the petitioner has no criminal antecedent and the police ahs submitted charge sheet in this case.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Rajeev Ranjan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM (Sub Judge)- XV, Patna in connection with Phulwarisharif P.S. Case No. 529 of 2017.
