Petitioner, already in custody since 11-10-2017 seeks bail in SingheshwarAshthan PS case No. 115 of 2017 registered under Sections-302, 201/34 of the IPC.

The allegation in brief is that the informant's daughter, who also happens to be daughter-in-law of the petitioner was tortured in connection with further demand of dowry. It is alleged that the informant's daughter was being tortured and in that connection, earlier a complaint case alleging threat was also lodged. It is alleged that after killing, the dead body of the deceased was secretly disposed off.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.16544 of 2018 (2) dt.11-05-2018 petitioner is father-in-law and not the husband and the husband is in custody and, similarly situated other two co-accused, i.e. the brother of the deceased husband and his wife have been admitted to bail by a coordinate bench of this court vide Criminal Misc. No. 63379 of 2017. It is also submitted that marriage of the deceased was performed 13 years back.

Having considered the said facts and circumstances and the case as also the fact that petitioner's case stands on similar footing to that of co-accused Budhdeo Ram & others who have been admitted to bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with SingheshwarAshthan PS case No. 115 of 2017.
