The petitioners are in custody since 02.09.2017 in connection with Jalalgarh P.S. Case No. 84 of 2017 for the offence registered under Sections 363, 370/34 , 302, 201, 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the main allegation is against one Dilip Jaiswal and his wife Neha Devi. Though, the petitioner has not been named in the first information report, but subsequently, his name has surfaced on the basis of the confessional statement made before the police by one Dilip Jaisawal, who has also indicated the involvement of the present petitioners. It is further submitted that the said Dilip

Patna High Court Cr.Misc. No.18960 of 2018 (3) dt.01-05-2018 Jaiswal has now been extended the privilege of bail vide order dated 30.04.2018 passed in Cr. Misc. NO. 25705 of 2018. Under such circumstances, the present petitioners may also be released on bail, as the confessional statement made before the police has no evidentiary value.

Considering the aforesaid facts and circumstances of the case and the petitioners are in custody for over 6 months, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Jalalgarh P.S.
