The petitioner has been in custody since 24.10.2017 in connection with Sonepur P.S. Case No. 455 of 2017 for the offence registered under Sections 420, 467, 468, 469, 471 and 120(B) of the Indian Penal Cod, Section 3⁄4 of the Bihar Conduct of Examination Act, 1981 and Section 66(D) of the Information and Technology Act, 2000.

Learned counsel for the petitioner submits that he has falsely been implicated in this case on mere suspicion and no case is made out against him. Furthermore, recovery of mere mobile phone would not amount to an offence. The charges are wholly vague and misconceived.

No.61083 of 2017 (3) dt.19-01-2018 Having considered the entire facts and circumstances of the case and that no case is made out under Section 471 of the Indian Penal Code and also that the same is bailable and furthermore, because the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st Chapra, District Saran in connection with Sonepur P.S. Case No. 455 of 2017.
