Petitioners apprehend their arrest in a case registered under sections 363, 366A, 372/34 of the Indian Penal Code.
Prosecution case in brief is that on 1.12.2014 at about 5 A.M. Daughter of the informant had gone to attend the call of nature and was taken away by the co-accused on false pretext of marriage with the help of Suker Yadav and Awadesh Yadav on the motor bike of his maternal grand father Sukar Yadav to Balua. The mobile no. of co-accused is 9507352637 and 8226804426.
Patna High Court Cr.Misc. No.29566 of 2015 (2) dt.28-07-2015 2/2 On behalf of the petitioners it is submitted that petitioner have got no criminal antecedent. It is further submitted that the main allegation is against one Pintu Kumar with whom the victim is said to have eloped. So far as the petitioner no.1 is concerned, he has provided A.T.M. card to the co-accused while they were leaving for Jodhpur.
On behalf of the State it is submitted that the petitioners are named in the first information report. Considering the aforesaid facts, the above named petitioners in the vent of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri R.S. Tiwary, Additional District & Sessions Judge, Ist Cum Spl. Judge, Buxar in Brahampur (Nainijore) P.S. Case No. 327 of 2014, Subject to the conditions as laid down under section 438(2) Cr.P.C.
