The petitioner seeks bail in -Pirbahore P.S. Case No. 411 of 2017 registered for the offence punishable under Sections 461, 379 and latter Section 411 of the Indian Penal Code has been added.

Allegation against the petitioner is of committing theft.

It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. It has been further submitted that the petitioner is a student. The petitioner has got no criminal antecedent and is in custody since 04.10.2017. Similarly situated co-accused Ashok Ram from whose possession stolen mobiles have been

Patna High Court Cr.Misc. No.60622 of 2017(3) dt.16-01-2018 2/2 recovered has been granted bail by a co-ordinate bench of this Court vide order dated 16.11.2017 passed in Criminal Miscellaneous No. 54396 of 2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No. 411 of 2017.
