JUSTICE SUDHIR SINGH ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 323, 332, 333, 290, 291, 427, 435, 436, 337, 338, 379 and 307 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioner is that he was also one of the members of the mob which indulged in damaging hospital and setting fire on an Omni van as a road accident had taken place in which school children were injured.
It is submitted on behalf of the petitioner that he has falsely been implicated in the present case. There is no specific injury attributed against the petitioner nor there is any specific role assigned against him. General and omnibus allegation has been made against all the accused persons. The other co-accused have been granted bail vide Cr Misc. no. 1730 of 2016 and Cr. Misc. no. 1713 of 2016.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.10279 of 2016 (2) dt.08-04-2016 2/2 above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Falka (Pothia) P.S. Case no. 273 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
