JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Baikunthpur P.S. Case No.202 of 2013 registered under Sections 406, 420, 302 and 201/34 of the Indian Penal Code. Allegation in brief is that the informant's husband while earning overseas used to send money to one of the accused Dularchand Rai, when her husband returned back, to usurp the money killed him. This suspicion is raised because her husband was taken one day before by Dularchand Rai and thereafter dead body was found.
Learned counsel for the petitioner submits that the petitioner is a co-villager not concerned with Dularchand Rai, merely on suspicion he has been named in this case, Dularchand
Patna High Court Cr.Misc. No.62313 of 2017 (2) dt.10-01-2018 2 /2 Rai has been granted bail by a coordinate Bench of this Court by order dated 22.09.2014, passed in Cr. Misc. No.19600 of 2014, the petitioner is in custody since 17.10.2017 and charge-sheet has been submitted in this case.
Having considered the said facts and circumstances, petitioner Chandeshwar Rai @ Dahari Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in connection with Baikunthpur P.S. Case No.202 of 2013. (Arun Kumar, J.) S.Kumar/- U T
