JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-08-2015 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that seven F.I.R. named accused persons including the petitioner assaulted the son of the informant and took out Rs. 10,000/- and gold chain of the son of the informant. It is specifically alleged that Kaushal Poddar resorted to fire.
It is submitted by learned counsel for the petitioner that accusation is omnibus and general. Though during investigation, it has transpired that co-accused Manoj Mandal assaulted with Dabia on the neck of the son of the informant. Out of five injuries three injuries have been found to be caused by sharp cutting weapon and due to political rivalry the petitioner has been roped in the present case.

No.31951 of 2015 (2) dt.06-08-2015 2/2 Considering the nature of accusation and the fact that from the impugned order, it appears that specific accusation has not been levelled by the witnesses whose statement have been recorded during investigation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Sonbarsa P.S. Case No. 220 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Saharsa. Accordingly the application is disposed off.
