The petitioner apprehends his arrest in a case registered for the offence under Section 304(B), 201/34 of the Indian Penal Code.

It is a case of 'Dowry Death'. The petitioner alongwith other F.I.R. named persons are alleged to have committed murder of daughter of the informant and disappeared her dead-body, due to non-fulfillment of demand of dowry. Petitioner, who is husband of the deceased, denies the allegation and submits that deceased died due to suffering from heart disease and as such, no case under Section 304(B) of the I.P.C. is made out against petitioner.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is husband of deceased

Patna High Court CR. MISC. No.67666 of 2021(4) dt.17-10-2022 2/2 and there is specific allegation of demand of dowry. Deceased died in an unnatural circumstances within seven years of marriage at her matrimonial house.

Considering the nature and gravity of offence and the fact that petitioner is husband of the deceased and there is specific accusation of committing torture and demand of dowry against him, the prayer for anticipatory bail of petitioner is rejected.
