The petitioner seeks anticipatory bail in Pipra P.S. Case No.10 of 2017 instituted for the offences under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Earlier the petitioner has moved this Court vide Cr. Misc. No.23949 of 2017 and the same was rejected on 9.8.2017 but till date he has not surrendered before the court below. Process under Sections 82-83 of the Code of criminal Procedure has been initiated against the petitioner. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the

Patna High Court Cr.Misc. No.18649 of 2018 (3) dt.16-05-2018 prayer for bail is rejected. However, the petitioner is directed to surrender before the court below within a period of three weeks from today.

In failure to surrender, this Court directs the Senior Superintendent of Police, Motihari to take him into custody and produce him before the court below.
