Petitioner, already in custody, seeks bail in connection with Govindganj (Malahi) P.S. Case No.166 of 2017, registered under Section 387 of the Indian Penal Code as well as under Sections 4/5 of the Explosive Substance Act.
Allegation in brief is that the informant found a suspected pressure cooker bomb kept in front of his shop of stone chips and sand and raises suspicion against unknown criminals regarding demand of extortion money. Learned counsel for the petitioner submits that the FIR is against unknown, except confessional statement of the petitioner made before the police, there is no other material against him and similarly situated other co-accused persons
Patna High Court Cr.Misc. No.12166 of 2018(5) dt.08-05-2018 2/2 Lallan Prasad Azad @ Netaji @ Azad Lalan Prasad, Anjay Sah @ Anjay Kumar Sah, Ramashish Sah, Ambika Sah @ Ambika Prasad and Basant Prasad have been admitted to bail by different co-ordinate Benches of this Court vide Cr. Misc. Nos.52277 of 2017, 51309 of 2017, 51858 of 2017, 52234 of 2017 and 53302 of 2017 on 09.11.2017 and 15.11.2017 respectively and the petitioner is in custody since 01.08.2017. Having considered the aforesaid facts and circumstances, petitioner Shatrughan Sah @ Shatrudhan Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, East Champaran, Motihari in connection with Govindganj (Malahi) P.S. Case No.166 of 2017.
