The petitioner seeks bail in connection with Bikramganj P.S. Case No. 305 of 2017 for offences punishable under Section 392 of the Indian Penal Code.
The allegation is regarding the accused persons having apprehended the informant, when he was going to his residence after collecting money and having snatched a sum of Rs. 40,000/- approximately on pistol point.
Learned counsel for the petitioner submits that the petitioner was not apprehended from the spot and merely on suspicion he has been implicated in the present case subsequently and probably on account of other cases pending against him as well as upon the confessional statement made by the co-accused person.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.21021 of 2018 (3) dt.17-05-2018 2/2 petitioner is languishing in custody since 03.02.2018 and although his antecedent is not very good but he has been falsely implicated and apprehended after being granted anticipatory bail in one of the cases.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-1st-cum Additional Chief Judicial Magistrate, Bikramganj (Rohtas) in connection with Bikramganj P.S. Case No. 305 of 2017.
