JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 25-01-2018 Yesterday, when the matter was called out, no one was present on behalf of the petitioner. This Court has made it very clear that if the learned counsel for the petitioner would remain absent on the next date, the Court will decide the case on merit. Even today, no one is present from the side of the petitioner. The matter relates to appointment of Child Development Project Officer against the advertisement, which has been published in the year 2005. The petitioner had applied for the said post, was declared successful in the preliminary test, she was

Patna High Court CWJC No.14739 of 2007 dt.25-01-2018 2/3 called upon to fill up the form for main examination. Accordingly, she filled up the form and deposited the requisite fee and where-after she appeared in the main examination, but she was not declared successful. The persons who were declared successful were called upon to participate in the interview board. Already 218 candidates have been recruited and appointed.

The grievance has been raised by the petitioner that in the main examination she has done very well, but wrongly she was not declared successful and she has been deprived of appointment to the aforesaid post.

As no one is coming forward to press this petition and also it appears that the petitioner appeared in the main examination but could not be declared successful, hence, she has raised a grievance that the Government has taken arbitrary decision and illegally notified the persons, who were selected in the main examination.

It is the matter of 2007, all recruitment process has already been completed much earlier, persons were selected and already joined the post and after lapse of such a long period of more than 9 years the claim of the petitioner has become very stale as the Commission must have been engaged in recruitment for subsequent years.

Patna High Court CWJC No.14739 of 2007 dt.25-01-2018 3/3 In such view of the matter, this Court does not find any merit in this writ petition. Accordingly, this writ petition is dismissed.
