ANJANA MISHRA ORAL ORDER 16-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Patliputra P.S. Case No.233 of 2015 for allegedly having committed the offence under Sections 420, 419, 120B of the Indian Penal Code and Section 66 of the I.T. Act.
Learned counsel for the petitioner submits that the petitioner is a responsible Company in the computer field. It has been making website for several organizations and has a clean reputation. It is submitted that though certain allegations have been made against the petitioner, the same was not done knowingly and the original complainant Fusion Microfinance
Patna High Court Cr.Misc. No.6492 of 2016 (4) dt.16-05-2016 2/3 Pvt. Ltd. has not complained by name against the petitioner. The petitioner and his Company are victims of the conspiracy and they have been cheated by one Balaji MicrofinancePvt.Ltd. Case diary in the present case was called for, which has since been received.
Learned counsel appearing on behalf of the State after perusal of the case diary submits that though such allegations have been made against the petitioner, it is not clear how a case under Sections 419 and 420 is made out. So far as the provisions of Section 66 of the I.T. Act are concerned, they are bailable.
In view of the aforementioned facts and circumstances and that the petitioner is a responsible Company operating in the State of Bihar and has a clean service record, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Patliputra P.S. Case No.233 of 2015, subject to the conditions as laid down under Section 438(2) of the Code
