====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 25-04-2023 Heard Mr. Arya Achint, learned Counsel appearing on behalf of the petitioner and Md. Shakir Ahmad, learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 13 of 2022 registered under Sections 498(A), 341, 323, 313 and 34 of Indian Penal Code, 1860 and Section 3/4 of Dowry Prohibition Act, 1961.

3. Learned counsel appearing on behalf of the parties informs that parties have agreed for one time settlement in course of the mediation. The report of the learned Mediator and the settlement agreement in this regard has been brought on record.

4. Considering the fact that parties have resolved their

No.56591 of 2022(3) dt.25-04-2023 2/2 dispute amicably in the interest of justice, the Court below is directed to release the petitioner provisionally on pre-arrest bail in terms of the agreement dated 24.03.2023 has been carried out by the petitioner as the petitioner has informed that Rs. 4,00,000/- (Four Lakhs only) remains to be paid to the Opposite Party No.2, after the remaining amount is paid within the period as agreed by the petitioner that is after one month.

Court below is directed to release the petitioner on provisionally on pre-arrest bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Munger, Bihar in connection with Mahila P.S. Case No. 13 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) nilmani/minuU
