Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. On account of running of hospital as well as establishment of medicine without license led raid and during course thereof there happens to be recovery of medicine in terms of seizure.

By way of supplementary affidavit, petitioner has submitted that no criminal antecedent happens to be, along with the fact that disclosure made in para 3 of the petition regarding case as Charpokhari P.S.Case No.178 of 2014, mistakenly been incorporated on account of wrong conception as in the aforesaid

Patna High Court Cr.Misc. No.46012 of 2014 (7) dt.06-07-2015 2/2 case one Kamlesh Kumar s/o Ram Naresh Rai happens to be the accused and not the petitioner Kamlesh Kumar Singh @ Kamlesh Kumar Singh son of Brij Bihari Singh.

Petitioner is in custody since 11.9.2014. Considering the nature of offence coupled with period of detention petitioner, Kamlesh Kumar Singh @ Sri Kamlesh Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara, in Ara (Town) P.S.Case No.354 of 2014.
