The petitioner seeks bail in a case registered for the offences punishable under sections 47(a)(f) of the Excise Act. In huge quantity country made liquor was recovered from a hut and the informant claims that the aforesaid hut was in possession of the petitioner. Admittedly, the petitioner was not caught at the spot nor anything was recovered from his conscious possession.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, the petitioner above named is directed to be released on bail on

Patna High Court Cr.Misc. No.8295 of 2016 (2) dt.25-02-2016 furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate West Champaran at Bettiah in connection with Excise Case No. 15 of 2014, Tr. No. 228 of 2015.
