Petitioner, already in custody, seeks bail in connection with Sasaram (Model) PS Case No.1199 of 2017 registered under Sections 457, 380 and 411/34 of the Indian Penal Code. Allegation in brief is that the petitioner was trying to steal the mobile from the window of the house of the informant as a result the mobile fell down and the informant woke up, chased and apprehended the petitioner and five mobiles were recovered.

Learned counsel for the petitioner submits that the recovered mobiles were not stolen one and the petitioner has been apprehended merely on suspicion, he has no criminal antecedent and has been in custody since 29.08.2017.

Saddam is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sasaram in connection with Sasaram (Model) PS Case No.1199 of 2017.
