2. The petitioner is seeking regular bail in connection with Chakai P.S. Case No. 193 of 2021 for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a) and 41 of the Bihar Prohibition Excise Act.
3. Allegedly, 169.50 liters of foreign illicit liquor was recovered from a car and the petitioner is said to be driver of the car.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered from possession of the petitioner. He has also submitted that the petitioner has no criminal antecedent of similar nature. The
Patna High Court CR. MISC. No.64281 of 2024(2) dt.18-09-2024 2/2 petitioner is under custody since 09.04.2024.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court-I, Jamui in connection with Chakai P.S. Case No. 193 of 2021, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
7. The petitioner shall cooperate in the disposal of the trial and make himself available on each and every date fixed at the trial, and if he fails to appear on two consecutive dates, without any reason or unavoidable circumstances, the learned court below shall be at liberty to cancel his bail bond.
