JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2018 Earlier prayer for bail of the petitioner was rejected vide order dated 19.8.2017 passed in Cr.Misc.No.39223 of 2017 with direction to trial court to expedite the trial and conclude it within a period of four months and if not concluded the petitioner may renew his prayer for bail. This case is under Section 498A IPC. Submission of learned counsel for the petitioner is that period of four months has expired and trial not been concluded and, as such, present application has been filed for grant of bail. From the report, which has been called for from the trial court, it appears that the case is still pending at the stage of framing of charge.

In the facts and circumstances of the case, let petitioner,
Patna High Court Cr.Misc. No.60978 of 2017 (3) dt.10-01-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Jamui, in connection with Jamui Mahila P.S.Case No. 01 of 2017, G.R. No. 52 of 2017, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) he will co-operate in trial and appear in court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
