Learned counsel for the petitioner submits that all the offences whereunder cognizance has been taken is not applicable in the background of the fact that he had volunteered his vehicle to facilitate election work but, due to break down the intervening four days were not at all properly been explained, subsequent thereof, again shown his presence and the vehicle was released after completion of the election work. The aforesaid materials have been collected during course of investigation.
The learned lower court, in case those materials are found in the case diary, at the stage of Section 239 of the Cr.P.C. will consider the same and in terms thereof, instant petition is disposed of.
