1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in Sessions Trial No.09 of 2021 arising out of Belhar P. S. Case No.221 of 2020 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302, 506 of the Indian Penal Code.

3. This is the third attempt of the petitioner to seek bail.

4. The learned counsel for the petitioner very fairly submits that the trial has commenced and out of eleven (11) witnesses, five (05) witnesses have been examined, but then, it appears that rest witnesses are not interested in appearing before the Court for giving evidence. It is also submitted that till date, officials witnesses have not been examined.

5. Since petitioner is alleged to be the main assailant and trial has commenced and as such, the Court is not inclined to release the petitioner on bail.

6. Accordingly, the prayer for bail of the petitioner stands rejected.

7. However, in the event, if the trial is not concluded within a period of nine months from the date of receipt/production of a copy of this order, the petitioner will be at liberty to renew his prayer for bail.
