The petitioner apprehends his arrest in connection with Uda Kishunganj P.S. Case No. 72 of 2015 registered for the offences punishable under Sections 420, 323, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present case has been lodged with oblique motive of defeating the right of this petitioner and the petitioner has already transferred the land in favour of the complainant-informant since 2004 itself and he has been enjoying proceeds of the land for almost 11 years.

Considering the aforesaid submissions, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be

Case No. 72 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
