Mr.Ajay Kumar No. 2 ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-09-2024 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Chautham P.S. Case No. 121 of 2024 dated 03.05.2024 registered for the offences punishable u/s 363, 366A of the Indian Penal Code.

3. As per the prosecution case, the minor daughter of the informant went to attend coaching class but she did not return. After intense search, the informant came to know that the petitioner in connivance with other co-accused persons have kidnapped his daughter. It is further alleged that some days ago the co-accused Sujit Kumar had threatened the informant of dire consequences.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to village politics. The petitioner is the father of the co-accused

2/2 Sujit Kumar and due to this he has been dragged in this case. There is no specific allegation levelled against him. There is no eye witness of the alleged offence. It is further submitted that victim has not stated about the complicity of petitioner in the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. He is languishing in custody since 06.05.2024.

5. Learned A.P.P. for the State and learned Counsel for the informant have vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Chautham P.S. Case No. 121 of 2024.

7. The application stands allowed.
