JUSTICE MADHURESH PRASAD ORAL ORDER 16-11-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 25(1-b)a, 26 and 35 of the Arms Act.

Having clean antecedent, petitioner is in custody since 09.04.2019 on allegation of recovery of a loaded pistol. It is submitted that prosecution case is false and recovery was not in accordance with law. It is also submitted that petitioner comes from a respectable agriculturist family. Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount

Patna High Court CR. MISC. No.52544 of 2019(4) dt.16-11-2019 2/2 each to the satisfaction of the S.D.J.M. (West) , Muzaffarpur in Kanti P.S. Case no. 277/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
