The sole petitioner, who is in custody since 11.10.2017 in Dumraon P.S. Case No. 296 of 2017, registered for the offence under Section 30(a) /47of the Bihar Prohibition And Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that save and except confessional statement of the co- accused, there is no other material to connect petitioner. He has also drawn my attention to the statement made in paragraph no. 3 of the petition to show that petitioner is having clean antecedent. Learned Additional Public Prosecutor has tried to persuade the court that petitioner is the owner of the vehicle

Patna High Court Cr.Misc. No.55537 of 2017(2) dt.29-11-2017 2/2 however , he has not brought to the notice of the court any specific document or material to show that petitioner was the actual owner of the vehicle.

Be that as it may , considering the nature of accusation, period of custody, let the petitioner Majhil Ram @ Manjhil Ram be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.D.J. - II - cumSpecial Judge Excise Act, Buxar / concerned court in connection with Dumraon P.S.
