The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 04.02.2021, charge-sheet has been submitted in this case and has antecedent of one case. Allegation is of looting the motorcycle and mobile of the informant, who is a Railway employee.
The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. No T. I. Parade was made and as far as recovery of the motorcycle is concerned, from the house of the petitioner, it is submitted that
Patna High Court CR. MISC. No.67108 of 2021(3) dt.18-04-2022 2/2 first the seizure list was made and thereafter, confession of the petitioner was obtained and as such, it cannot be said that recovery was on account of confession.
Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and in the nature of allegation ass alleged, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Akbarnagar P. S. Case No.05 of 2021.
The application stands allowed.
