The petitioner is languishing in custody in connection with Ara (Town) P.S. Case No. 125 of 2014 for the offences instituted under Sections 341, 323, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier bail application of the petitioner was rejected vide Cr. Misc. No. 18700 of 2015 dated 31.07.2015 with an observation at this stage and liberty was granted to the petitioner to renew his prayer after six months. This is second attempt for grant of bail.
A report was called for from the Court below regarding the stage of the case and same is marked as flag 'A'. It
Patna High Court Cr.Misc. No.6868 of 2016 (3) dt.02-08-2016 2/2 has been reported that the charge has already been framed. The prosecution story in brief, is that the informant registered his fardbeyan stating that the accused persons attacked him and the petitioner shot at by a country made pistol on the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.03.2015. There is no allegation of tampering of the witnesses against the petitioner. There is no injury caused by the petitioner upon vital part of the body and no repetition of firing is alleged against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara, in connection with Ara Town P.S.
