2. In this case, the petitioner is seeking regular bail in connection with Bhagwanpur P.S. Case No. 71 of 2024, registered for the offences punishable under Sections 341, 323, 376, 379, 498A, 504, 506, 34 of the Indian Penal Code.

As per allegation, the petitioner forcibly established sexual relation with the informant so the informant became pregnant and gave birth to a child and thereafter, the informant's family members due to fear of the society solemnized marriage of the informant with the petitioner with the help of other accused persons but after few days the accused persons started assaulting her physically, snatched her ornaments and ousted her

Learned counsel for the petitioner has submitted that the informant is legally-wedded wife of Ganesh Kumar @ Ganesh Singh who had lodged Divorce Case No. 82/2024 against the informant on the ground of adultery. The informant has also lodged Complaint Case No. 464/2024, in which she has stated that Ganesh Kumar was her husband. It has further been submitted that these facts have intentionally been concealed in the FIR and learned counsel has also submitted that the petitioner has falsely been implicated due to some ulterior motive. He is under custody since 08.07.2024.

Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Vith, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 71 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
