It is submitted by Mr. Anil Kumar Jaiswal, learned Counsel, appearing on behalf of the petitioner, that upon investigation of Hazipur Town P.S. Case No.
730 of 2014, the Investigating Officer submitted his report, under Section 173(2)(i) of the Code of Criminal Procedure, as a final report, stating therein that no case of commission of any offence, as alleged, had been made out and that the said report was accepted by the learned Chief Judicial Magistrate, Vaishali at Hazipur. It is submitted, on behalf of the petitioner, that, as against the order, dated 12.10.
Patna High Court Cr. WJC No.239 of 2016 (2) dt.18-03-2016 2/2 petition may, therefore, be allowed to be withdrawn. In view of the above statement, made on behalf of the petitioner, the application is hereby disposed of as withdrawn with liberty granted to the petitioner to make, if so advised, appropriate application putting to challenge, by way of revision, the order, dated 12.10.2015, whereby the police report submitted by the police was accepted by the learned Chief Judicial Magistrate and also to take recourse to such provisions of law as may be permissible.
